BALANCED BREATH AND MOVEMENT ONLINE CLASS LIABILITY WAIVER

PLEASE READ CAREFULLY. BY PURCHASING OR PARTICIPATING IN THIS COURSE, YOU ACKNOWLEDGE AND AGREE TO THE TERMS BELOW.

1. ASSUMPTION OF RISK
   I, the participant, acknowledge that engaging in physical movement, breathing exercises, and mobility training involves inherent risks, including but not limited to muscle strains, joint injuries, dizziness, falls, or other medical complications. I understand that my participation in this program is entirely voluntary and that I may discontinue participation at any time. I expressly consent to and voluntarily assume the risk of all injuries that may result from my participation in this online movement course, and all economic or noneconomic damages that I may incur as a result of such injuries.
2. MEDICAL DISCLAIMER
   I understand that this course is for educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. I understand that many injuries and medical conditions can only be diagnosed and treated by a physician. I affirm that I am physically able to participate and have consulted a qualified healthcare provider if I have any concerns regarding my health or ability to engage in movement activities. I understand that the instructor is not providing medical advice and that any exercises performed are undertaken at my own risk.
3. RELEASE OF LIABILITY
   I hereby release, discharge, and hold harmless Essential Physical Therapy LLC, its members, managers, owners, instructors, affiliates, employees, and representatives from any and all claims, liabilities, demands, and expenses (including legal fees) that may arise from my participation in this course, including but not limited to personal injury, property damage, or any other loss.
4. HOLD HARMLESS AND INDEMNIFICATION
   I agree to hold harmless, indemnify and defend Essential Physical Therapy LLC and its affiliates against any claims, damages, or expenses incurred as a result of my participation in this course or any injury I or any third party may sustain. I agree that if I bring a legal action against Essential Physical Therapy LLC and do not prevail, Essential Physical Therapy LLC may recover all costs and attorney’s fees that it has incurred in defending the legal action.
5. NO GUARANTEES OR WARRANTIES
   I understand that results from this course may vary, and no specific outcomes are guaranteed. Essential Physical Therapy LLC makes no representations or warranties regarding the effectiveness or safety of the exercises provided.
6. INTELLECTUAL PROPERTY
   I acknowledge that all materials provided in this course, including videos, documents, and written content, are the intellectual property of Essential Physical Therapy LLC and may not be copied, shared, or distributed without written permission. I understand that Question and Answer sessions will be recorded. I consent to such recording and understand that all recordings or transcriptions thereof shall be the sole property of Essential Physical Therapy LLC, and may be viewed by others at the discretion of Essential Physical Therapy LLC. I waive any claims that I could have for misappropriation of my likeness arising out of such recordings.
7. GOVERNING LAW
   This agreement shall be governed by and construed in accordance with the laws of the state of Colorado. Any disputes arising under this agreement shall be resolved in a court of competent jurisdiction in La Plata County, Colorado.
8. SEVERABILITY

If any provision of this waiver is deemed invalid or unenforceable, the remaining provisions shall survive and remain in full force and effect.

9. MODIFICATIONS

No agreement to modify the terms of this waiver shall be effective unless such agreement is reduced to writing and signed by participant and a representative of Essential Physical Therapy LLC.

10. NO REFUNDS
    Refunds are not available for the Balanced Breath and Movement class series.
11. AGREEMENT TO TERMS
    By purchasing or participating in this course, I acknowledge that I have carefully read, understood, and agree to this waiver and release of liability. I affirm that I am at least 18 years old or have parental/guardian consent to participate. I acknowledge that by signing this form, I am relinquishing significant legal rights voluntarily and without any coercion. By checking the agreement box during registration or purchase, I acknowledge and agree to the terms set forth in this liability waiver.
